V-DENTAL TERMS AND CONDITION OF USES

Please read these Terms and Conditions carefully. By using the Services (as defined below), you agree that you have read, understood, and accepted the Terms and Conditions applicable to you. These Terms and Conditions and V-Dental’s policies (as defined below) constitute a legally binding agreement between you and V-Dental (as defined below) and govern your use of the Services provided by V-Dental. If you do not agree to these Terms and Conditions, please do not use or continue using the App or Services.

Introduction to V-Dental Platform

V-Dental operates as an owner and manager of a healthcare platform in dentistry, including website systems and mobile applications. The platform connects patients with doctors and medical facilities, enabling convenient appointment booking through online tools.

General Provisions

The application providing e-commerce intermediary services is called V-Dental.

Definitions

V-Dental App: An application providing online booking services for medical and dental facilities, collectively referred to as "Healthcare Providers."

Patients/Clients: Individuals seeking healthcare services.

Healthcare Providers: Organizations, individuals, medical facilities, and doctors with the requisite expertise, business licenses, or permits for medical services under the law.

Transportation Services: Transportation services provided through V-Dental’s platform for patients.

Intellectual Property: Includes patents, copyrights, registered or unregistered designs, trademarks, service marks, or any other intellectual or industrial property rights.

Terms and Conditions

By accessing or using V-Dental’s services, you agree to the following terms and conditions. We reserve the right to modify these terms without prior notice. Any changes will take effect immediately upon being posted on our platform.

If you are a User, you represent, warrant, and agree that:

You will comply with V-Dental's policies.

Your use of the services is solely for yourself, for personal purposes, or for a minor at least 12 years old ("Minor"), for whom you assume full responsibility.

You will not use the platform or software to harass, disrupt, or book fake appointments.

If applicable, you agree to provide accurate information about the number of clients when booking services. Inaccurate or false information may result in cancellation of your booking and a potential cancellation fee.

If you directly contact a Healthcare Provider for bookings, payments, or agreements outside of V-Dental, you will not be entitled to any rights or claims through V-Dental.

You will not intentionally or unintentionally harm Healthcare Providers or V-Dental.

You will not copy or reproduce any content displayed through the App or Platform without permission.

You acknowledge that only one account can be registered on a single device.

If applicable, standard telecommunication charges will apply when requesting services via SMS.

V-Dental reserves the right to deactivate inactive accounts after six (6) months of no transactions.

If you are a Dental Clinic, you hereby affirm, ensure, and commit to the following:

General Principles

Dental Clinics listed on V-Dental represent healthcare service providers specializing in dental care, referred to as "Dental Clinics." All images, documents, videos, and other materials about the clinic and its services provided to customers are for reference purposes and are collected from materials supplied by the clinic. V-Dental assumes no responsibility for the absolute accuracy of the information provided by the clinic.

When listing dental services on V-Dental, healthcare service providers specializing in dental care must comply with the provisions of Article 25 of Circular 41/2011/TT-BYT, Circular 41/2017/TT-BYT, Article 26 of Decree 109/2016/NĐ-CP, Article 10 of Decree 155/2018/NĐ-CP, Article 43 of Decree 109/2016/NĐ-CP, and other relevant legal documents governing dental clinic operations. For dental clinics that are legal entities with foreign investment, providers must have a valid business license in accordance with current laws.

All documents requested from the healthcare service provider specializing in dental care ("Dental Clinics") must be guaranteed and committed to being scanned directly from original documents without falsification, modification, or erasure.

Healthcare service providers specializing in dental care ("Dental Clinics") are responsible for paying applicable taxes as required by the regulations of the jurisdiction in which the clinic is located.

Providers must comply with V-Dental's rules and regulations, as well as fulfill the terms of any specific contractual agreements between the two parties.

Using V-Dental

Healthcare Provider Information:

Information about doctors, medical services, and facilities (collectively "Healthcare Providers") is posted on V-Dental’s platform. While we strive to provide accurate information, we cannot guarantee absolute accuracy.

Online Appointment Booking :

V-Dental offers an online platform that connects patients with doctors and healthcare facilities for appointment bookings. However, V-Dental does not directly provide medical services or represent Healthcare Providers.

Appointment Changes and Cancellations:

Appointments booked through V-Dental may be subject to changes due to medical scheduling. We will notify you via SMS, email, or phone. If you do not receive a notification, please contact us for support.

Consultation and Booking Fees

Currently, booking appointments through V-Dental is free of charge. In certain cases, you may receive discounts on medical costs when booking through our platform.

Refund Policy

Doctor Refusa:
If a doctor refuses the appointment due to unsuitability or incorrect specialization, 100% of the cost will be refunded.

Appointment Cancellations:

Within 2 hours of the appointment: 5% cancellation fee (for non-rescheduled appointments).

More than 2 hours before the appointment: Full refund.

More than 3 non-payable cancellations within 2 hours: The user’s account will be locked and blacklisted.

Refund Timeline:
Refunds will be processed within 5-7 working days (excluding weekends).

Emergency Cases

V-Dental is not an emergency medical service. In case of emergencies, please immediately call emergency services or visit the nearest medical facility

Disclaimer

V-Dental is not responsible for the quality, effectiveness or cost of services provided by Healthcare Providers.

Limitation of Liability

V-Dental’s liability is limited to matters that cannot be excluded under Vietnamese law.

V-Dental’s Role

Pre-consultation:
Online consultation, appointment reminders, guidance, and appointment booking.

During Consultation:
Assistance with arising issues.

Post-consultation::
Feedback collection, resolving professional issues, and protecting patient rights.

Free Follow-Up Support

Patients may receive free follow-up consultations (excluding testing and medication costs) if dissatisfied with the initial consultation and if the request is reasonable.

Notifications

Notifications will be sent via the app, SMS, email, or phone. You may unsubscribe from notifications at any time.

PRIVACY POLICY

Purpose and Scope of Information Collection

V-Dental collects members' information, including email, phone number, username, password, and customer address. This information is mandatory when members register to use the services for V-Dental to confirm and contact customers, ensuring consumer rights.

Members are responsible for securing their login information and activity under their username and password. If misuse or security breaches are detected, members must immediately notify the V-Dental e-commerce platform.

Scope of Information Use

Members' information will be used by V-Dental for the following purposes:

Providing services to members.

Sending notifications about transactions between members and V-Dental.

Preventing account violations or impersonation.

Contacting members to resolve special cases.

Providing information to legal authorities upon request (e.g., prosecution, courts, or investigation agencies).

Information Retention Period

Members' personal data will be stored until a request for deletion is made or when the member logs in and requests deletion. In any case, personal information will be securely stored on V-Dental's servers.

Entities authorized to access members' personal information include:

V-Dental management.

Partners contracted with V-Dental, who are granted access to information as per their contracts.

State authorities upon request.

Buyers and healthcare partners in case of disputes.

Means and Tools for Users to Edit Personal Data

Members have the right to review, update, modify, or delete their personal information by logging into their account or requesting V-Dental to make the changes. Members can file complaints if their personal information is leaked and request V-Dental to secure the information again.

Commitment to Personal Information Security

V-Dental is committed to keeping members' personal information strictly confidential and will not disclose it to third parties without members' consent, except as required by law. In case of a hacker attack resulting in personal data loss, V-Dental will notify the relevant authorities and inform the members.

V-Dental is not responsible for incorrect personal information provided by members during registration.

Mechanism for Receiving and Resolving Complaints Related to Personal Information

Members can file complaints regarding personal information breaches and request V-Dental to resolve them. V-Dental is committed to securing information using encryption and other protective measures. If there is a violation of the purpose of information collection, V-Dental will resolve it through the following process:

1. Customers provide feedback.

2. The customer service team receives and processes the complaint.

3. If necessary, V-Dental will escalate the matter to the competent authorities.
